BENNION ON STATUTORY INTERPRETATION

Keeping the Fifth Edition updated

In furtherance of his ongoing interest in statute law, from time to time Francis Bennion prepares Notes which give information on new or newly-discovered cases, articles etc relating to matters dealt with in the Fifth Edition of Bennion on Statutory Interpretation. References in such cases, articles etc to previous editions of that work are converted so that they refer to the corresponding passage in the fifth edition. Cases referred to in these Notes can be accessed on BAILII.

The Notes do not purport to be an official updating of the work. For past editions, such updating has been done by FB by way of the All England Annual Review, Supplements and new editions. For the fifth and future editions it is intended that the chapter in the All England Annual Review and the Supplements will be done jointly by Kay Goodall, Senior Lecturer in Law, University of Stirling and Ian McLeod, Visiting Professor of Law, University of Teesside; Associate Senior Research Fellow, Institute of Advanced Legal Studies, University of London. FB is now retiring from active participation in the work, while of course retaining his moral right in it.

There are two ways in which you can find out whether there is one of FB’s Notes relating to a point in which you are interested.

The first way is via Table A. This enables you to see, arranged in alphabetical order, the entries in the fifth edition Index which are dealt with by FB’s Notes. From this you can move to Table B, in which you can find any Note that interests you.

The other way, for use when you are working on a certain page in the fifth edition, is to go straight to that page in Table B. There you will find the relevant Note if there is one.

Entries in the Index to the fifth edition on this website are highlighted if they appear in Tables A and B. Enties in Tables A and B, that were not in the original Index to the fifth edition, have been added to the Index on this website and are shown highlighted and enclosed in square brackets.

Appendix E (List of Terms) Occasionally there are new cases, articles etc which throw light on the legal meaning of a term which is included in Appendix E to the fifth edition or could be suitably added to it. These are listed below as they arise.

Term Note Authority
adduce 'The word “adduce” read in its context means ‘put forward and rely upon’. R (on the application of Warden and Fellows of Winchester College and another) v Hampshire County Council [2009] EWCA Civ 431, [2008] 3 All ER 717, at [56].
fairness 'The meaning of “fairness” is context-specific’. Aribisala v St James Homes (Grosvenor Dock) Ltd [2008] EWHC 456 (Ch) 762 at [10].
